Product Label Compliance

The FDA regulates the labeling of most food products, except meat, dairy and egg products. The regulations require every food and beverage label to contain mandatory information, such as a statement of identity, the manufacturer, packer or distributor’s name and address, net quantity, nutritional facts, ingredients list and allergen risks. In addition to the mandatory requirements, labels may include various claims about the product, including nutrient content claims, health claims or structure/function claims, under specific conditions and requirements.

In addition to labeling requirements, any advertising of food and beverage products must comply with the laws regulated by the Federal Trade Commission (FTC). Any promotional publication or broadcast of a food or beverage product, including information posted on websites, must be truthful and not misleading. Any advertising claims must be substantiated by competent and reliable scientific evidence.
